Terms & Conditions
These Terms and Conditions ("Terms") govern your relationship with the remote gambling operator providing access to the Win Spirit online casino brand via the website https://winspiritplay-au.com (the "Site") and any related services. By accessing or using the Site you agree to be bound by these Terms. If you do not agree, you must not use the Site. These Terms are effective as of 1 January 2026 and replace all previous versions.
Definitions
For the purposes of these Terms, the following definitions apply:
- Operator means Complete Technologies N.V., a private limited liability company (N.V.) registered in Curaçao under company number 153194, operating the Win Spirit brand via the domain winspiritplay-au.com, acting directly and/or through its designated payment agent(s). Where relevant, references to "we", "us" or "our" are to the Operator.
- Payment Agent means any third-party company appointed by the Operator to process payments on its behalf, including but not limited to the office at Churston Building, 1st Floor, 171 Arch. Makariou III Ave, 3027 Limassol, Cyprus, which acts as a payment agent of the Operator.
- Site means the website https://winspiritplay-au.com and any related mirror or substitute domains, mobile sites, applications or services used to access the Win Spirit online casino, including those that may be used to circumvent blocking measures.
- Win Spirit or Win Spirit means the online gambling brand, games and related services made available by the Operator exclusively through the Site for review and play purposes by users located in or accessing from Australia.
- User or Player means any natural person who accesses the Site, whether or not they complete registration or place a Bet. References to "you" and "your" are to the User.
- Account means a registered player account opened and maintained by a User with the Operator through the Site.
- Games means all casino games, slots, live casino, table games and any other gambling products offered on the Site at any time.
- Bet or Stake means any sum of money risked on the outcome of a Game by a Player using funds in their Account.
- Wager means the total cumulative amount of Bets placed using either bonus funds or real money where such wagering is required to meet a bonus or promotion condition.
- Bonus means any promotional benefit, including free spins, bonus money, cashback, tournament entries or other incentives credited by the Operator to a Player's Account subject to specific conditions.
- Promotion means any marketing offer, campaign, tournament, loyalty program, or other scheme under which a Player may receive a Bonus or other benefit.
- KYC ("Know Your Customer") means all identity, age, residence, source of funds and other verification checks that the Operator may require to comply with its licence conditions, anti-money laundering measures, risk controls and internal policies.
- Deposit means a transfer of funds by a Player into their Account using payment methods approved on the Site.
- Withdrawal means a request and successful transfer of funds from a Player's Account to a payment method in the Player's name.
- Unauthorised Use means any use of the Site or an Account in breach of these Terms, including under-age gaming, fraud, multiple accounts, chargebacks, or access from prohibited jurisdictions.
- Business Day means any day other than Saturday, Sunday or public holidays in Curaçao or Cyprus (for payment processing purposes).
Regulatory Notice for Australian Users: The Operator is licensed by Antillephone N.V. in Curaçao under licence number 8048/JAZ2014-053. The Site and Operator are not licensed in Australia, operate as an offshore online casino, and have been identified by the Australian Communications and Media Authority (ACMA) as operating in breach of the Interactive Gambling Act 2001 (Cth). Australian consumer protection and gambling regulations do not apply to your relationship with the Operator.
Account Registration
Eligibility and Age Requirements
- Minimum age: You may create an Account only if you are at least 18 years old or the minimum legal gambling age in your country of residence, whichever is higher. By registering, you confirm that you meet this requirement.
- Jurisdictional restrictions: You are solely responsible for ensuring that accessing and using the Site complies with the laws applicable to you. The Site is not authorised by Australian regulators, and using offshore gambling services may be unlawful in Australia. You access the Site at your own risk, including when using VPNs or mirror domains.
- One Account rule: You may open only one Account with the Operator. Duplicate Accounts (including under different emails, names, or IP addresses) may be closed and associated balances cancelled, particularly where bonuses have been abused.
Registration Process
- Account creation: To open an Account, you must complete the online registration form on the Site, providing at least your full name, date of birth, country of residence, email address, chosen password and any other requested details. Information must be accurate, complete and current.
- Email verification: We may require you to verify your email address by clicking an activation link or entering a verification code sent to you. We may suspend or restrict your Account until verification is completed.
- KYC and documentation: At any time, including before or after Deposits or prior to a Withdrawal, we may request supporting documents, such as:
- Government-issued photo ID (passport, driver's licence, national ID).
- Proof of address (utility bill, bank statement) not older than three months.
- Proof of payment method ownership (redacted bank statement, card copy, e-wallet screenshot).
- Any additional documents required to satisfy our legal, licensing or risk obligations.
User Obligations
- Accuracy of data: You must keep your registration information up to date and notify us promptly of any changes. Providing false, misleading or incomplete information constitutes a material breach of these Terms and may lead to Account closure and forfeiture of funds, especially in cases of fraud or under-age gambling.
- Password and security: You are responsible for maintaining the confidentiality of your login credentials and for all activities undertaken through your Account. You must:
- Use a strong, unique password and change it regularly.
- Not share your credentials with any third party.
- Notify us immediately at [email protected] if you suspect any unauthorised access or breach of security.
- Personal use only: Your Account is for your personal, non-commercial use. You must not act on behalf of others, operate as an agent, or use your Account for money transfer, payment processing or any non-gambling purpose.
- Prohibited activities: You must not use the Site for illegal or fraudulent activities, including money laundering, terrorist financing, collusion, use of stolen payment methods, chargebacks, bots, automated systems or game manipulation.
Betting & Gameplay Rules
General Gameplay Conditions
- Game rules: Each Game is subject to the specific rules and payout tables displayed within the Game interface. By placing a Bet, you confirm that you understand and accept the applicable Game rules.
- Randomness and fairness: Outcomes of Games are determined by a random number generator (RNG) or live dealer procedures, as certified under the Operator's Curaçao licence. Some or all Games may not be independently tested under Australian standards.
- Currency and language: The default currency and language of your Account and the Games will be indicated on the Site. Exchange rates and currency conversions, if applicable, are determined by your payment provider and/or the Operator's processing partner.
Placing Bets
- Accepting Bets: A Bet is considered accepted only when it is registered on our servers. The transaction history in your Account is the conclusive record of Bets placed, accepted, won or lost.
- Minimum and maximum stakes: Each Game may have its own minimum and maximum Bet limits, displayed within the Game. The Operator may also impose overall Account-level limits. You are responsible for checking these limits before playing.
- Bet confirmation: Once you click the relevant button to confirm a Bet, it will be immediately and irrevocably placed, subject to technical acceptance by the system. You may not cancel or change a Bet after it has been accepted, except where explicitly allowed by a Game's built-in functionality.
- Time of Bet: The official time of a Bet is the time recorded on our servers, not your device time or local time.
Cancellation, Errors and Malfunctions
- Obvious errors: In the event of an obvious error or malfunction (including misconfigured paytables, incorrect odds, software bugs, display errors, or a Game operating contrary to its published rules), we may void the affected Bet(s), cancel winnings derived from the error and, where appropriate, restore the original balance as if the Bet had not been placed.
- Interrupted play: If your connection is lost during a Game round:
- For slots and similar games, the outcome may be completed in the background and reflected in your Account upon reconnection.
- For live casino or time-sensitive Games, your Bet may stand and the outcome will be determined by the Game provider in your absence.
- Technical failures: If a Game is disabled, rolled back or otherwise affected by a significant technical failure, we may declare the Game round void, cancel affected Bets and return the Bet amount to your Account, without any further obligation.
Conduct in Live Casino and Chats
- Prohibited behaviour: You must behave respectfully towards dealers, other Players and staff. The following are strictly prohibited in chats, live tables and any interactive features:
- Insults, harassment, hate speech or discriminatory language.
- Threats, abusive content or sexually explicit remarks.
- Advertising other services, sharing personal data, spamming or trolling.
- Collusion, sharing strategies to exploit system weaknesses or urging others to breach these Terms.
- Moderation and sanctions: We may monitor communications and may mute, restrict or permanently block your chat access and/or Account if you breach conduct rules. Serious misconduct (including threats, racism or fraud) may result in immediate termination of your Account.
- Fraud and abuse: Any attempt to use bots, scripts, multi-accounting, chip dumping, collusion, exploiting loopholes, or intentionally disconnecting to gain advantage will be treated as fraud. We may:
- Void affected Bets and confiscate winnings.
- Close your Account and bar you from future use of the Site.
- Report suspected criminal activity to relevant authorities.
Bonus Terms
General Bonus Principles
- Bonus-specific rules: Each Bonus or Promotion advertised on the Site or via email, SMS or other channels is governed by both these Terms and specific promotional terms. In case of conflict, the specific promotional terms prevail for that Promotion.
- Eligibility: Bonuses are granted at the Operator's discretion and may be restricted by country, currency, payment method, account status, or prior bonus history. We may refuse, withhold or withdraw a Bonus if we reasonably believe it is being abused.
- One per person/household: Unless stated otherwise, each Bonus is limited to one per person, household, IP address, device, email address and payment method. Using multiple accounts or identities to claim the same Bonus is strictly prohibited.
Activation and Wagering Requirements
- Activation: A Bonus may require:
- Entering a bonus code when making a Deposit.
- Selecting the offer in the cashier or promotions section.
- Clicking an activation link sent to you by email or displayed on the Site.
- Wagering requirements: Unless otherwise specified, Bonus funds and any winnings derived from them are subject to a wagering requirement before they can be withdrawn. For example, a 40x wagering requirement means you must place qualifying Bets totalling 40 times the Bonus (and, where applicable, deposit) amount.
- Time limits: Bonuses are available for a limited period (e.g. 7 - 30 days from activation). If the wagering requirement is not met within the specified timeframe, the Bonus and any related winnings may be removed from your Account.
- Contribution of Games: Different Games may contribute differently to wagering. For example:
- Slots: up to 100% contribution.
- Table games / live casino: reduced or 0% contribution.
- Excluded games: 0% contribution.
Prohibited Bonus Practices
- Irregular play: The following may be treated as bonus abuse and may result in confiscation of winnings and closure of your Account:
- Placing very low-risk or opposite Bets (e.g. betting on red and black simultaneously) to meet wagering.
- Using "bonus hunting" strategies, including building progression systems solely to clear bonuses with minimal risk.
- Delaying or "parking" bonus rounds, free spins or features to claim them after wagering is completed or after making a Withdrawal.
- Making a large Bet relative to your deposit or bonus amount shortly after receiving a Bonus, where this was not intended by the offer.
- Maximum Bet with bonus: A maximum Bet limit per spin/round may apply while wagering a Bonus (e.g. a fixed amount stated in the promotional terms). Placing Bets above the allowed maximum may lead to forfeiture of the Bonus and related winnings.
Combining Promotions and Withdrawal Rules
- No automatic combination: Unless explicitly allowed, Promotions cannot be combined. If more than one active Bonus is technically possible, wagering will be applied in the order and manner determined by the Operator.
- Real money vs bonus money: In most cases, Bets are placed using real money first and Bonus funds second, but the Operator may apply a different sequence as described in specific promotional terms.
- Withdrawals before wagering completion: If you request a Withdrawal before meeting the applicable wagering requirements, the Operator may:
- Cancel the Bonus and all associated winnings; and
- Process the Withdrawal using only your remaining real-money balance, subject to these Terms.
- Right to amend or cancel: We may modify, suspend or cancel any Promotion or Bonus where necessary for legal, regulatory or operational reasons, or where a Promotion is found to be misconfigured or abused. Such changes will not affect rights already exercised, subject to our right to act against abuse.
Payments & Withdrawals
Deposit Methods and Conditions
- Payment options: The Site may offer Deposits via:
- Credit and debit cards (where permitted).
- E-wallets and online payment services.
- Bank transfers.
- Cryptocurrencies or other alternative methods (where available).
- Ownership of payment methods: You may only use payment instruments legally held in your own name. Using third-party cards, accounts or wallets is prohibited and may lead to Account closure.
- Deposit limits: The Operator may impose minimum and maximum Deposit amounts per transaction or per period. Such limits will be indicated in the cashier interface.
- Fees and charges: The Operator does not generally charge Deposit fees, but reserves the right to do so and will display any such fees in the cashier. Your bank, card issuer or payment provider may impose their own fees, exchange rates or restrictions.
Withdrawals
- General rule: You may request a Withdrawal of available funds in your Account, subject to:
- Completion of any applicable wagering requirements.
- Satisfactory completion of KYC checks.
- Compliance with these Terms and any promotional terms.
- Withdrawal methods: Where possible, Withdrawals will be made via the same payment method used for Deposits. If this is not feasible, we may offer an alternative method. We may require proof that you are the legitimate holder of the target account.
- Limits and processing times:
- Minimum and maximum Withdrawal limits per transaction and per period may apply and will be displayed in the cashier.
- We aim to process Withdrawal requests within a reasonable timeframe (e.g. 1 - 5 Business Days), but this may vary due to KYC checks, payment processor delays or other operational factors.
- Additional delays may arise from your bank or payment provider, over which we have no control.
- Fees: We may charge a reasonable processing fee for Withdrawals, particularly for multiple Withdrawal requests within a short period, or where Deposits have not been fully wagered. Any such fees will be disclosed in the cashier before you confirm the Withdrawal.
Anti-Fraud, Chargebacks and Closed-Loop Policy
- Anti-fraud checks: All Deposits and Withdrawals are subject to monitoring for fraud, money laundering and other suspicious activity. We may suspend or reverse transactions, freeze funds and report activity to financial institutions or authorities where legally required or reasonably necessary.
- Chargebacks: If you dispute or reverse a payment (chargeback), we may:
- Immediately freeze or close your Account.
- Void Bets and confiscate winnings related to the disputed funds.
- Recover the amount of the chargeback, plus any associated costs, from any remaining or future balances.
- Closed-loop withdrawals: Where possible, Withdrawals must follow a "closed-loop" principle, meaning they are returned to the same method used for Deposits, to reduce fraud and money laundering risk.
Refunds of Bets, Deposits and Bonuses
- No credit or banking services: The Operator does not provide credit or banking services. Funds in your Account do not accrue interest and are not covered by any Australian deposit guarantee or consumer protection scheme.
- Bet settlement: Bets once accepted are final and cannot normally be cancelled or refunded, except where:
- An error or malfunction requires voiding the Bet; or
- We decide at our absolute discretion to grant an exceptional refund.
- Refund of Deposits: Refunds of unused Deposits may be granted in limited circumstances (e.g. self-exclusion, clear error), at the Operator's discretion and subject to anti-money laundering checks. Where Deposits have been wagered, no refund will normally be possible.
- Bonus funds: Bonuses and associated winnings are non-refundable and may be removed if wagering conditions or these Terms are not met.
Limitation of Liability
Operator's Obligations
- Service provision: The Operator will use reasonable skill and care to:
- Provide access to the Site and Games as available.
- Ensure that Bets are recorded and settled correctly according to the applicable Game rules.
- Apply Bonuses and Promotions in accordance with their terms.
- Fairness: The Operator seeks to offer fair and transparent Games operated under its Curaçao licence 8048/JAZ2014-053. However, the Games are not regulated or approved by Australian authorities, and no warranty is given that they satisfy Australian technical or fairness standards.
Exclusions of Liability
- Technical issues: To the maximum extent permitted by applicable law, we are not liable for any loss or damage resulting from:
- Internet outages, latency, disconnections or failures caused by your ISP, device or network.
- Viruses, hacking, denial-of-service attacks or other malicious events affecting your connection or device.
- Hardware or software incompatibility, including browser issues, outdated drivers or unsupported operating systems.
- Indirect and consequential loss: We are not liable for:
- Loss of profits, revenue, opportunity or business.
- Loss or corruption of data.
- Any indirect, consequential, incidental or punitive damages arising out of your use of the Site or Games.
- Regulatory and legal risks: You acknowledge that:
- The Site operates offshore and in breach of the Australian Interactive Gambling Act 2001.
- Australian consumer law and gambling regulations do not apply to the Operator.
- ACMA may block the Site and related domains at any time, which may affect your access to your Account. We are not responsible for loss of access due to regulatory blocking or related measures.
Maximum Liability
- Cap on liability: Without prejudice to the exclusions above, and to the extent permitted by applicable law, the total aggregate liability of the Operator to you arising out of or in connection with your use of the Site, whether in contract, tort (including negligence) or otherwise, shall in all circumstances be limited to the lesser of:
- (a) the amount of the Bet or Stake that gave rise to the claim; or
- (b) the amount actually credited to your Account and lost due to the event giving rise to the claim.
- No limitation for certain matters: Nothing in these Terms excludes or limits any liability that cannot be excluded under the law governing these Terms, such as liability for fraud or fraudulent misrepresentation.
Intellectual Property Rights
Ownership of Content and Software
- Operator rights: All intellectual property rights in and to the Site, including but not limited to software, source code, algorithms, databases, trademarks, trade names, logos, designs, text, graphics, audio-visual material, and other content, are owned by the Operator, its affiliates or its licensors and are protected by copyright, trademark and other applicable laws.
- Third-party content: Games and related content may be provided by third-party software suppliers. All rights in such content remain with the respective suppliers, and your use is subject to these Terms and any applicable supplier conditions.
Permitted and Prohibited Uses
- Limited licence: We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Site and Games solely for your personal, non-commercial entertainment, subject to these Terms.
- Restrictions: You must not, without our prior written consent:
- Copy, reproduce, distribute, publish, transmit, modify, adapt, translate, reverse-engineer, decompile or disassemble any part of the Site, software or content, except as expressly allowed by law.
- Exploit any part of the Site or Games for commercial purposes, including by mirroring the Site, data scraping, framing or deep-linking.
- Remove or alter any copyright, trademark or other proprietary notices on the Site or Games.
- User content: By submitting any content (e.g. chat messages, feedback), you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, modify, adapt, publish and display such content for the purposes of providing and improving the Site, moderating communications and complying with legal obligations.
Privacy & Data Protection
- Privacy Policy: The collection, use, storage and disclosure of your personal data in connection with the Site and your Account are governed by our Privacy Policy, as amended from time to time. By using the Site, you confirm that you have read and understood the Privacy Policy.
- Data processing: We process personal data for purposes including Account administration, KYC verification, payment processing, risk management, compliance with our Curaçao licence and applicable anti-money laundering laws, marketing (where permitted) and customer support.
- Cross-border transfers: Your personal data may be transferred to and processed in jurisdictions outside your country of residence, including Curaçao, Cyprus and other locations where our servers, affiliates or service providers are located. Such jurisdictions may not have data protection laws equivalent to those in your home country.
- Australian law note: As the Operator is not licensed or established in Australia, Australian privacy and data protection laws may not apply to our processing of your data. Your rights and remedies in the event of a data breach or misuse may therefore be limited.
Changes to Terms
- Right to amend: The Operator may update or amend these Terms at any time for legal, regulatory, technical or business reasons, including to reflect changes in our services, our Curaçao licence or relevant offshore regulations.
- Notification: Where we make material changes, we will take reasonable steps to notify you, such as:
- Posting an updated version of the Terms on the Site with a revised "effective date".
- Displaying a banner, pop-up or similar notice on the Site.
- Sending an email notification to the address registered to your Account.
- Acceptance of changes: Continued use of the Site after the effective date of the updated Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must:
- Stop using the Site immediately; and
- Contact us to close your Account and request Withdrawal of any remaining eligible funds, subject to these Terms.
Termination & Suspension
Operator's Rights
- Suspension and closure: We may, at our reasonable discretion, suspend, restrict or close your Account and/or withhold funds if:
- We suspect breach of these Terms, including fraud, collusion, money laundering, bonus abuse or under-age gambling.
- You fail to provide satisfactory KYC documentation.
- We are required to do so by law, by our Curaçao licence or at the request of a regulatory, law enforcement or payment authority.
- Your Account has been inactive for a prolonged period in accordance with our internal policies.
- Confiscation of funds: Where we have strong evidence of serious breach (e.g. fraud, chargebacks, identity theft, criminal activity), we may confiscate some or all funds in your Account, subject to applicable law.
User's Right to Close the Account
- Voluntary closure: You may request closure of your Account at any time by contacting customer support at [email protected]. Before closing the Account, we may:
- Settle all outstanding Bets.
- Require KYC documents if not already provided.
- Process any Withdrawal of remaining eligible funds, subject to these Terms.
- Self-exclusion and limits: Where available on the Site, you may set deposit limits or request temporary or permanent self-exclusion. These tools are limited in scope and do not equate to Australian-licensed responsible gambling protections.
Effects of Termination
- Access and use: Upon closure or suspension of your Account, you must stop using the Site and any access credentials may be disabled.
- Funds on termination:
- If we close your Account for reasons other than serious breach, we will, where possible, return any remaining real-money balance after deducting any applicable fees and subject to KYC checks.
- Bonuses and unfinished wagering requirements will lapse upon closure.
- Surviving provisions: Any provisions of these Terms that by their nature should survive termination (including limitation of liability, intellectual property, governing law and dispute resolution) shall remain in force.
Governing Law & Jurisdiction
- Governing law: These Terms, your Account and any dispute arising out of or in connection with your use of the Site shall be governed by and construed in accordance with the laws of Curaçao, excluding any conflict-of-laws rules that would result in the application of another jurisdiction's laws.
- Primary dispute resolution: If you have a complaint, you should first contact our customer support at [email protected], providing all relevant details and supporting evidence. We will use reasonable efforts to investigate and respond within a reasonable timeframe.
- Escalation: If you are not satisfied with our response, you may be able to escalate your complaint in accordance with our licence conditions under Antillephone N.V. as set out on the licence validator page: https://validator.antillephone.com/validate?domain=winspirit.com. Any such process is governed by Curaçao regulatory frameworks and not Australian law.
- Jurisdiction: Subject to any mandatory arbitration or regulatory complaint procedure required under our Curaçao licence, you agree that the courts of Curaçao shall have exclusive jurisdiction to settle any dispute arising out of or in connection with these Terms or your use of the Site.
- Australian law statement: You acknowledge that Australian courts and regulators generally treat offshore online casinos as operating in breach of the Interactive Gambling Act 2001 and that Australian consumer law protections do not apply to your relationship with the Operator. By using the Site, you accept this legal risk.
